The following terms used in this article shall have the meaning ascribed to them in this section.

Garbage: waste from the preparation, cooking and consumption of food, market refuses, waste from the handling, storage and sale of produce.

Refuse: Tree branches, shrubbery, trimmings, earth and wastes from building operations, solid wastes resulting from industrial processes and manufacturing operations, such as food processing, wastes, boilerhouse cinders, lumber, scraps and shavings and excrement from animals.

Trash:

(a)   Combustible: Paper, cartons, boxes, barrels, wood and excelsior, wood furniture, bedding.

(b)   Noncombustible: Metals, tine cans, metal furniture, dirt, small quantities of rock and concrete, glass crockery and other mineral refuse.

(c)   Ashes: Residue from fires used for cooking and heating buildings.

(d)   Street Rubbish: Street sweepings, dirt, leaves, catchbasin dirt, contents of litter receptacles.

It shall be unlawful for any person to throw, place, deposit or leave or cause to be thrown, placed, deposited or left, in any of the public streets, highway, alleys, parks or thoroughfares of the City, any dirt, filth, sewage, dung, excrement, compost, papers, stable manure, boxes, ashes or litter of any kind.

It shall be unlawful for any person to throw, drop, cast or deposit upon any street, alley, sidewalk or any yard or premises, public or private, filth of any kind, or cans, paper, trash, paper containers, rubbish, bottles, wood shavings, brush, tree trimmings, or any form of litter or waste matter.

No garbage, trash or refuse shall be burned in the streets and alleys of the City of West Plains under any circumstances, and no garbage, trash or refuse shall be burned on private property, except in location and under conditions approved by the Meade County Refuse, Garbage, Trash and Solid Waste Utility Board.

It shall the duty of every business and occupant within the City of West Plains to provide a sufficient number of containers for the deposit therein of garbage of all garbage of not more than thirty-two (32) gallons capacity, constructed of metal or any other material approved by the Meade County Utility, with a tight-fitting lid or cover, which such cover shall remain in place on the container at all times, except during the collection or deposit of such garbage, and with handles sufficiently strong for workmen to empty conveniently.

All garbage containers shall be placed and kept at or near some convenient place for removing.

Every garbage container required by this article shall be maintained in as sanitary condition as possible in view of the use to which it is put and shall be thoroughly cleansed as needed by washing, scalding, sterilizing or otherwise.

It shall be the duty of every person owning, controlling, managing, operating, policing, renting or occupying any premises where garbage and/or trash accumulates to replace within ten (10) days after receipt of condemnation notice issued by the Meade County Utility superintendent, any containers that have deteriorated or that have jagged edges capable of causing injuries those whose duty it is to handle the containers, or that have been damaged to such an extent.

Heavy accumulations, such as brick, broken concrete, lumber, ashes, dirt and plaster, sand or gravel, automobile frames and parts, dead trees and other bulky, heavy material, shall be disposed of at the expense of the owner or person controlling same under the Utility superintendent.

(a)   Base rate. The following rates are established as those to be paid to the City Clerk of the City of West Plains, for collection and hauling of trash and refuse.

(1)   All single family dwellings or residences within the City of Plains, Kansas, with a water meter shall be charged a monthly rate of $15.15 per month per dumpster.

(2)   All businesses within the City of Plains, Kansas, with a water meter shall be charged a monthly rate equivalent to the number of dumpsters used by such business, multiplied by the number of times each dumpster is regularly emptied per week, times the rate of $19.50.

A request for water or electric service shall automatically constitute a request for refuse service. ‘

(a)   Trees, less than 4 inches in diameter, branches and shrubbery trimmings shall be securely tied in bundles which shall not exceed 18 inches in diameter, nor 48 inches in length and shall not, regardless of size, exceed 30 pounds in weight.

(b)   Books, magazines and newspapers may be securely tied in bundles or placed in disposable containers in lieu of placing in an approved container. Such bundle or container and contents shall not exceed a weight of 30 pounds.

(c)   Empty cardboard boxes shall be flattened. No trash other than books, papers, magazines or lawn clippings shall be placed in cardboard containers.

Solid Waste in residential areas shall be collected not less than once weekly. All commercial solid waste shall be collected at intervals as may be fixed by the Meade County Utility Manager.

Rocks, dirt, sod, concrete and building material shall be disposed of only in sites and in a manner approved by the Utility Superintendent.

Bills for refuse service shall be rendered monthly at the same time as bills for sewage, water and electric light services are rendered. Such Bills shall be collected as a combined bill for sewage, water and electric service.

Any person, firm or corporation at the time of beginning or terminating service for a period of less than 16 consecutive days shall be billed at one-half (1/2) of regular monthly rate. For service of 16 consecutive days or more, the charge shall be at the full monthly rate.

Failure to pay refuse service charge in full within 10 days of the date shown on the combined refuse, sewage, water and electric bill, will cause refuse, sewage and water service to the property terminated. No fee shall be charged to reinstate service.
