There is hereby fixed and established a minimum monthly service charge of Ten Dollars ($10.00) per month per meter within the corporate limits of the City of Plains, Kansas, and a minimum monthly service charge of Thirty Dollars ($30.00) per month per meter outside the corporate limits of the City of Plains, Kansas, for the use of water from the Municipal Water Works, mains and extensions, of said City of Plains, Kansas, and all consumers shall pay said city for all water consumed as shown by the water meter of such respective consumer the following rates per month:

First 3000 gallons, or part thereof: Ten Dollars ($10.00)

All above 3000 gallons: One Dollar ($1.00) per thousand gallons, or part thereof.

The minimum monthly service charge shall be Ten Dollars ($10.00) per month for each meter within the corporate limits of the City of Plains, Kansas, and a minimum monthly service charge of Thirty Dollars ($30.00) per month for each meter outside the corporate limits of the City of Plains, Kansas, provided that the City shall furnish a 3/4” meter to be used by the consumer.

Each consumer shall make a cash deposit to secure the payment of final service bills for each service meter, and such deposit shall be paid to the City Clerk before service is made available to the consumer. The amount of the cash deposit required shall be based on an amount equal to the estimated service to be taken during a two month period, but in no case shall the cash deposit to secure such service be less than $60.00; provided, however, that when cash deposits are insufficient to fully secure payment for a two month period, the City may require such additional deposits as are reasonable and necessary to fully secure all services.

Any unpaid charges herein established shall be collected as authorized by K.S.A. 12-860 and/or Chapter 15, Article 1.

(a)   There is hereby established a separate and distinct class of water meter to be known as yard water meters.

(b)   A yard water meter is to be defined as a residential meter used for lawn watering only at a residence which has a water meter for general usage that drains into the City sewer system.

(c)   The expense of purchasing a yard water meter shall be that of the customer. Thereafter, customers will have the following options:

(1)   The customer pays no monthly minimum charge. Thereafter, if a city employee determines that the yard meter was not functioning properly, the customer will be responsible for the repair or replacement of the meter by a city employee and said cost of repair or replacement shall include the City’s labor costs. The meter will be read from March 15 through October 15 and at least once during the winter months.

(2)   The customer can pay a monthly minimum charge of $8.00. Thereafter, if a city employee determines that the yard water meter is not functioning properly, the City would be responsible for the repair or replacement of the yard water meter including the City’s labor costs. The meter would be read on a monthly basis.

(d)   In the event the customer does not file a written choice with the City Clerk of the City of Plains, Kansas relative to the option selected under subsection (c), it shall be conclusively presumed that option (c)(1) was the choice of the customer.

(e)   Yard water meters shall be exempt from sewer charges as set out in Chapter 15, Article 3.

(f)   Water use through yard meters shall be billed at the City’s usual and current water rates which may be set from time to time by the Plains City Council.
