14-201.      Animal waste spilled from vehicles.

(a)   Waste from domestic animals and/or livestock spilled from vehicles and trailers hauling or transporting domestic animals and/or livestock, and the prolonged parking of such vehicles and trailers with waste from domestic animals therein creates a public nuisance on the streets of the City of Plains, in that the spillage is slippery and reasonably foreseeable to cause pedestrian and/or vehicle accidents. Furthermore, such spillage and prolonged exposure of vehicles and trailers parked with waste from domestic animals therein is detrimental to the health of the citizens of the City of Plains, degrades the quality of the environment, and causes economic loss.

(b)   It shall be the duty of any person(s) owning or operating vehicles and trailers hauling or transporting domestic animals and/or livestock, which spills waste from domestic animals and/or livestock on the streets of the City of Plains, to provide for immediate cleanup of such spillage coming from such vehicle(s), and trailer(s).

(c)   In lieu of immediately cleaning the affected street within the City of Plains, payment for the cleanup thereof shall be made by the owner or operator of such vehicle and trailer to the City of Plains, in an amount not less than $100.00 and not more than the actual cost of the cleanup, which amount shall be set by the Municipal Judge of the City of Plains after taking into consideration the amount of spillage and the difficulty of clean up.

(d)   No vehicle or trailer with waste from domestic animals therein shall be parked on the streets and alleys of Plains, Kansas, within 500 feet of a zoned residential area.

14-202.      Truck routes.

(a)   For the purposes of this section, the term “trucks or other commercial vehicles” means any truck, pickup, truck trailer, tractor or any vehicle whether self-propelled by an engine or motor or whether the same is towed behind or pushed ahead of a motor vehicle when such vehicle or combination of vehicles has a gross weight of 8,000 pounds or more, and is including, but not limited to any construction equipment such as motor patrols or graders, bulldozers or caterpillar type tractors. For the purpose of this section, the term “gross weight” shall mean the total weight of any truck or trailer or any other combinations of vehicles being towed or pushed by a similar propelling vehicle.

(b)   Trucks and Commercial Vehicles Prohibited on the Streets and Alleys of Plains, Kansas: No truck or other commercial vehicle as defined herein shall be operated or parked upon the streets and alleys of Plains, Kansas, and such operation or parking shall be unlawful and any person, firms, partnership or members of partnerships found guilty of a violation of this section, shall be deemed to have committed a misdemeanor.

(c)   Exceptions: The provisions of this section shall not apply to any of the following:

(1)   Any truck or other commercial vehicle while engaged in loading or unloading cargo, not including personal belongings or the like, at a residence or a commercial establishment on such said streets and alleys.

(2)   Any truck or other commercial vehicle engaged in providing utility or other necessary services to inhabitants of the City of Plains, Kansas, or to any truck or other commercial vehicle that is directly or indirectly providing services to the City of Plains, Kansas, pursuant to contractual arrangements with the City of Plains, Kansas, including but not limited to franchise agreements/ordinances.

(3)   Any truck or other commercial vehicle having a gross weight of 60,000 pounds or less enroute to or from the owner’s property.

(4)   Any truck or other commercial vehicle parked as follows:

(A)  On the south side of the 100 block of Indiana Street; or

(B)  On the east side of both the 300 and 400 blocks of West A Street.

(5)   Any truck or other commercial vehicle operation upon:

(A)  Grand Avenue;

(B)  Ontario Street;

(C)  Madison Street;

(D)  Iowa Street;

(E)   On any of the streets within the borders of US Highway 54 on the south, Grand Avenue on the west, Park A venue on the north, and Madison Street on the east; or

(F)   The portion of the streets where truck or other commercial vehicle parking is authorized as provided in subparagraph C hereinabove, provided the portion of said streets are accessed directly from Grand A venue immediately adjacent thereto.

14-203.      Transportation of explosives or inflammables.

(a)   This section shall apply to all motor vehicles and trailers used for the transportation of explosive or inflammable liquids, substances, or gases whether the transportation of such explosive liquids, substances or gases is accomplished in a tank or container permanently attached to or temporarily placed on or attached to said vehicle or trailer except that it shall not apply to any container which is 250 gallons capacity and less or is used solely for the purpose of supplying fuel for the propulsion of the vehicle upon which it is mounted.

(b)   It shall be unlawful for any person, firm or corporation to keep, park, store or permit to stand or remain upon any street, alley or private property within any of the residential districts of the City of Plains, Kansas, as such districts are described and delimited by the city zoning ordinances, any vehicle with or without cargo used for the transportation of explosive or inflammable liquids, substances or gases except while such vehicle is being loaded or unloaded.

14-204.      Transportation of liquid fertilizer.

(a)   This section shall apply to all motor vehicles and trailers used for the transportation of Liquid Fertilizer (Anhydrous Ammonia) whether the transportation of such is accomplished in a tank or container permanently attached to or temporarily placed on or attached to said vehicle or trailer.

(b)   That it shall be unlawful for any person, firm or corporation to keep, park, store or permit to stand or remain upon any street, alley or private property within any of the residential districts of the City of Plains, Kansas, as such districts are described and delimited by the city zoning ordinance, any vehicle, with or without, cargo used for the transportation of Liquid Fertilizer (Anhydrous Ammonia).

14-205.      No parking zones.

(a)   Parking of vehicles on the center island of Grand Avenue shall be prohibited during certain times.

(1)   Said NO PARKING area shall be designated by painting the curbs yellow, placing barricades on the south edge and the north edge of the NO PARKING area and posting NO PARKING signs at the north and south edge of the NO PARKING area. When the aforementioned conditions are complied with by the City Police Department, no parking of a vehicle shall be permitted.

(2)   The NO PARKING area created shall be used for vehicles in excess of 24,000 pounds as a turning area when entering or departing from a grain Elevator loaded or unloaded. That no vehicle shall be allowed to use said NO PARKING area except those complying with the weight classification and those complying with the purpose hereinabove stated.

(b)   It shall be unlawful to park any vehicle on the east side of Grand Avenue from the intersection of South Second Street to the intersection of North First Street.

(c)   It shall be unlawful for any person to park any semitrailer vehicle on the streets or alleys in the residential area of said city; provided, however, that such vehicle may be so parked temporarily for the purpose of taking on cargo from or unloading cargo into a residence or business location.

(d)   It shall be unlawful to park any semitrailer vehicle on the Main Street between Iowa Street and North Third Street or in the north and south alleys lying in the blocks immediately adjoining said portion of Main Street between the hours of 7:00 P.M. and 7:00 A.M.; provided, however, that such vehicle may be so parked temporarily for the purpose of taking on cargo from or unloading cargo into a residence or business location.

14-206.      Speed limits.

The following maximum speeds shall be applicable to all vehicles:

(a)   upon the road designated as U.S. Highway 54 within the city’s corporate limits of said city of Plains, Kansas:

(1)   from the west corporate boundary line of said city to a point 0.10 miles east of said west corporate boundary line of said city, 40 miles per hour;

(2)   from a point 0.10 miles east of said west corporate boundary line of said city to the east corporate boundary line of said city, 50 miles per hour.
